Sec. 1 Scope and provider

(1) These General Terms and Conditions (hereinafter "Terms") apply to all contracts concluded via this booking portal between

The American Dream – US Visa Service GmbH, Danckelmannstr. 9, 14059 Berlin, Germany (hereinafter "Provider", "we")

and you as the customer (hereinafter "Customer") regarding the booking of services relating to US travel authorisations and US visas.

(2) The version of these Terms valid at the time the contract is concluded shall apply. Deviating terms of the Customer shall not become part of the contract unless the Provider expressly agrees to their validity in writing.

(3) A consumer within the meaning of these Terms is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the legal transaction, acts in the exercise of their trade, business or profession.

Sec. 2 Subject matter and important notice

(1) The Provider renders support, advisory and service activities in connection with applications for US travel authorisations (e.g. ESTA), US visas (e.g. B-1/B-2, F-1, J-1, work and investor visas) and programmes such as Global Entry. The specific scope of services results from the respective product or service description in the portal.

(2) The Provider is a private service provider and is not affiliated with any government authority of the United States of America. The examination of and decision on the granting of a travel authorisation, a visa or admission to a programme rests exclusively with the competent US authorities (e.g. CBP, U.S. Department of State, U.S. Embassy/Consulate).

(3) The Provider owes the careful provision of the agreed service, but not the issuance of the respective authorisation or visa or any other administrative outcome. A particular outcome of the procedure is neither owed nor guaranteed.

(4) Official fees of the US authorities (e.g. ESTA fee, MRV/visa fee, SEVIS fee, Global Entry fee) are governmental charges and are not part of the Provider's fee unless expressly stated otherwise in the service description.

Sec. 3 Conclusion of contract

(1) The presentation of services in the portal does not constitute a legally binding offer, but an invitation to submit an offer (invitatio ad offerendum).

(2) By clicking the order button (e.g. "order subject to payment") at the end of the order process, the Customer submits a binding offer to conclude a contract for the services contained in the shopping cart. Beforehand, the Customer can check their entries at any time and correct them using the usual keyboard and mouse functions.

(3) The Provider confirms receipt of the order without undue delay by email. This acknowledgement of receipt does not yet constitute acceptance of the offer. The contract is concluded as soon as the Provider separately confirms acceptance of the order (order confirmation) or begins performance of the service.

(4) The contract text is stored by the Provider and sent to the Customer in text form together with the order confirmation. The contract language is German; an English version serves comprehension only.

Sec. 4 Prices and payment

(1) The prices stated in the portal at the time of ordering apply. All prices are final prices including statutory value added tax, where applicable.

(2) Insofar as official fees or third-party expenses (e.g. authority fees, translations, certifications, shipping costs) are incurred for the provision of the service, these are shown separately unless they are expressly included in the service price.

(3) Payment is made via the payment methods offered in the ordering process. Payment processing may be carried out via the payment service provider Mollie B.V.; their terms apply in addition in this respect. Unless otherwise agreed, the fee portion is due for payment upon conclusion of the contract.

(4) The Customer may only offset claims of the Provider with undisputed or legally established counterclaims.

Sec. 5 Customer's duties to cooperate

(1) The Customer is obliged to provide all information, documents and declarations required for the provision of the service completely, truthfully and in good time, and to notify any changes without undue delay.

(2) The Customer is responsible for the accuracy and completeness of the information they provide. The Provider is not liable for delays, additional work or a rejection by the authorities that is based on incorrect, incomplete or late information provided by the Customer.

(3) The Customer ensures that the email address they provide is reachable and that communications from the Provider are not blocked by filters.

Sec. 6 Consultation appointments

(1) Consultation appointments can be booked via the portal or by telephone. The applicable fees result from the respective service description.

(2) A free-of-charge cancellation or rescheduling of an agreed consultation appointment is possible until 3:00 p.m. on the previous day at the latest. In the event of later cancellation or no-show, the agreed fee may be invoiced, insofar as the Provider allows the value of saved expenses to be credited.

Sec. 7 Right of withdrawal

(1) Consumers are entitled to a statutory right of withdrawal in accordance with the separate withdrawal instructions, which also contain the model withdrawal form.

(2) The right of withdrawal expires prematurely if the Provider has fully provided the service and only began performance after the consumer gave their express consent and at the same time confirmed their awareness that they lose their right of withdrawal upon full performance of the contract.

(3) If the consumer requests that the service begin during the withdrawal period, they must, in the event of an effective withdrawal, pay a reasonable amount for the services already provided (compensation for value).

Sec. 8 Confidentiality

The Provider treats all information that becomes known to it in the course of processing the order as confidential and does not pass it on to uninvolved third parties without the Customer's consent, unless this is necessary for the performance of the contract (e.g. transmission to the competent bodies) or required by statutory obligations. Details on the processing of personal data are governed by the privacy policy.

Sec. 9 Liability

(1) The Provider is liable without limitation for damages arising from injury to life, body or health based on a negligent or intentional breach of duty, as well as for other damages based on an intentional or grossly negligent breach of duty.

(2) In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), the fulfilment of which makes the proper performance of the contract possible in the first place and on whose compliance the Customer may regularly rely, liability is limited to the foreseeable damage typical for the contract.

(3) In all other respects, the Provider's liability – on whatever legal grounds – is excluded.

(4) Liability under the Product Liability Act and under an assumed guarantee remains unaffected. The above limitations of liability also apply in favour of the Provider's legal representatives and vicarious agents.

(5) Liability for the success of administrative procedures, in particular for the issuance of authorisations or visas, is excluded (cf. Sec. 2).

Sec. 10 Dispute resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. The Provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Sec. 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not thereby withdrawn.

(2) If the Customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the Provider's registered office.

(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
